CASTORINA: SPEED CAMERA LAW ‘UNCONSTITUTIONAL’

 Assemblyman Ron Castorina Jr. (R,C,I,Ref-South Shore) publicly criticized Assemblywoman Deborah Glick’s speed camera bill as “unconstitutional” and a “cash grab” by the city of New York today. The bill (A. 7798) would expand the photo speed violation monitoring systems program, or “speed cameras,” for school speed zones in the city of New York.   

             “Adding speed cameras at every corner and in every school district in the city of New York will not only fail to deter speeding, but will undoubtedly violate our rights as Americans,” said Castorina. “We have a system in place where those who choose to speed are caught and punished and this goes beyond that system all in the name of expediency. Not only that, but we cannot allow such a violation of our rights simply to rake in more cash for the city’s coffers.

 

            “Assemblywoman Glick and her supporters may argue this is about ‘safety,’ but have failed to provide any evidence of a correlation between the addition of speed cameras and a decline in speeding. Ms. Glick even went so far as to say, ‘I don’t know if that is the result of speed cameras’ and ‘I’ll guesstimate.’ I would ‘guesstimate’ the American people would not want their constitutional rights violated in favor of a program that’s efficiency cannot be substantiated. Cars crash, pedestrians get injured, but those facts alone don’t substantiate the claim that when more cameras are added we somehow become safer. 

 

            “Instead of achieving any of the bill’s promoted goals, it in fact violates the Fifth Amendment’s presumption of innocence clause, the Sixth Amendment’s confrontation clause and the equal protection clause of the 14th Amendment. We live in an era where we’ve witnessed serious overreaches into our privacy and this bill merely extends those violations. I vote no and I encourage my colleagues in the Senate to do the same.”
